Terms & Conditions
Nando’s Chickenland Singapore Pte Ltd is a company incorporated in Singapore under company number 200208738D, with its registered office at 16, Raffles Quay,#11-03, Hong Leong Building, Singapore 048581 (“Nando’s”,”we”, “us” or “our”). Nando’s operates two websites: www.nandos.com.sg (the “Nando’s Website”), www.order.nandos.com.sg (the “Ordering Website”, collectively referred to as the “The Websites”
- Understanding these Terms and Conditions
1.1. These terms and conditions (“Terms and Conditions”) are divided into four (very interesting and equally important) parts:
1.1.1. Part 1: the terms of use (“Terms of Use”). These describe how you may: (i) access and use each of The Websites and the content on each; and (ii) interact with each of The Websites, by (for example) submitting comments, images, videos or any other type of material. By using any of The Websites, you confirm that you accept the Terms of Use and that you agree to comply with them;
1.1.2. Part 2: the terms of sale (“Terms of Sale”). These set out the terms on which you may order the products available on the Ordering Website (“Products”). The Terms of Sale will become binding on you when you submit an order for Products via the Ordering Website; and
1.1.3 Part 3 : the terms of membership (“Terms of Membership”). These set out the terms on which you may collect rewards as part of the Nando’s loyalty scheme. By registering as a member (“Member”) you accept the Terms of Membership; and
1.1.4. Part 4: general terms (“General Terms”). These set out certain terms and conditions that apply equally to your use of each of The Websites, under the Terms of Use and any purchases that you make through the Ordering Website, under the Terms of Sale, including (for example) where you should direct any complaints and the law that governs these Terms and Conditions.
1.2. When certain words and phrases are used in these Terms and Conditions, they have specific meanings (these are known as “defined terms”). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of these Terms and Conditions where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).
1.3. When we refer to “we”, “us” or “our”, we mean Nando’s Chickenland Singapore Pte Ltd. When we refer to “you” or “your” we mean you, the person accessing or using The Websites.
PART 1: TERMS OF USE
These terms of use apply to your use of The Websites. If you are using the Nando’s Website then the “Website” in these Terms of Use refers to the Nando’s Website, if you are using the Ordering Website then the “Website” in these Terms of Use refers to the Ordering Website.
- The Website
2.1. The Website is made available free of charge. We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. Access to the Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period. We may update the Website and/or change the content on it at any time.
2.2. You are responsible for making all arrangements necessary for you to have access to the Website. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use and that they comply with them.
2.3. The Website and the content on it are provided for general information purposes only. They are not intended to amount to advice (medical or otherwise) on which you should rely.
2.4. You may only use the Website for your own domestic, private and non-commercial use.
- Your Account and password
3.1. You will need to register an account with us on the Website in order to access certain services available on the Website (“Account”). If you register an Account, you will be asked to provide your phone number and create a password as part of our security procedures. You must treat such information as confidential and you must not disclose it to any third party. It is best practice to create different passwords for each account.
3.1.1. You must be at least 18 years old to register an account. Minors must obtain their parent’s or legal guardian’s consent prior to participation. By submitting an application for the Account, you agree (or, if you are a minor, your parent or legal guardian agrees) to be bound by these Terms of Use.
3.2. We have the right to disable any Accounts and/or passwords, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms and Conditions.
3.3. If you know or suspect that anyone other than you knows your Account login details, you must immediately notify us at peri-peri@nandos.com.sg.
3.4. You are responsible for any unauthorised use of your Account login details.
3.5 See Part 3 for more Terms of Membership that apply to the Account.
- General Acceptance Use
4.1. You agree not to:
4.1.1. use the Website in any way that breaches these Terms of Use or any applicable local, national or international law or regulation;
4.1.2. copy, or otherwise reproduce or re-sell any part of the Website unless expressly permitted to do so in these Terms of Use; or
4.1.3. do any act or thing that might damage, disrupt or otherwise interfere with the operation of the Website or any equipment, network or software used in operating the Website.
4.2. User Generated Content
If it is the case that you supply/upload any content to the Website – whether it be pictures, text, sound recordings or whatever – the content you supply (“User Generated Content”) must comply with the following rules:
4.2.1. it must not be obscene, abusive, offensive or racist and it must not promote or propose hatred or physical harm against anyone;
4.2.2. it must not harass or bully another person;
4.2.3. it must be true and honest so far as you know;
4.2.4. it must not be defamatory of anyone;
4.2.5. it must not use the material or content or infringe the rights or privacy of anyone else; for example you should not use images of well-known characters, footage or music (unless it is your own);
4.2.6. it must not contain someone else’s personal details or confidential information relating to other people; and
4.2.7. it must not promote or condone terrorism, violence or illegal behaviour.
4.3. We reserve the right to refuse to accept or refuse or cease to use any User Generated Content supplied by any person that we think contravenes these rules.
4.4. In addition, we may from time to time provide interactive services on the Website that shall enable you to upload User Generated Content, including, without limitation:
4.4.1. comment facilities;
4.4.2. chat rooms; and/or
4.4.3. bulletin boards, (together “Interactive Services”).
4.5. Where we provide an Interactive Service, we will use reasonable endeavours to provide information to you about the kind of service offered and if it is moderated. However, we are under no obligation to oversee, monitor or moderate any Interactive Service we provide.
4.6. The use of any of our Interactive Services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online. Minors who are using any Interactive Service should be made aware of the potential risks to them.
4.7. Viruses
4.7.1 We do not guarantee that the Website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the Website and we recommend that you use your own virus protection software.
4.7.2 You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
- Intellectual property
5.1. We are the owner or licensee of all intellectual property rights in the Website and its content, the Nando’s name and mark and Nando’s product names, images and packaging. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.
5.2. You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these Terms of Use. You must not use the Website (or any part of it or its content) for commercial purposes; however, you may download material from the Website solely for non-commercial, personal use by you.
5.3. No part of the Website, including, without limitation, the text, designs, graphics, photographs and images contained in it, may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.
5.4. Any communications or materials you send to us through the Website by electronic mail or other means will be treated as non-proprietary and non-confidential (other than communications in respect of your order if you use the Website to buy products from us). We are free to publish, display, post, distribute and otherwise use any ideas, suggestions, concepts, designs, know-how and other information contained in such communications or material for any purpose, including, but not limited to, developing, manufacturing, advertising and marketing us and our Products. In particular, you grant us a non-exclusive, transferable, perpetual, royalty-free, worldwide licence to copy, use, reproduce, distribute, display, publish, adapt, prepare derivate works of and/or amend any User Generated Content in any format, including in our services and Products for any purpose including in relation to the promotion of our services and Products.
- Our liability
6.1. Nothing in these Terms of Use excludes or limits our liability for:
6.1.1. death or personal injury caused by our negligence;
6.1.2. fraud or fraudulent misrepresentation; and
6.1.3. any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
6.2. If we fail to comply with these Terms of Use, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Use or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you accessed the Website.
6.3. Nothing in these Terms of Use affects your statutory rights.
6.4. We only supply the Website for domestic and private use. You agree not to use the Website, or any content on the Website, for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
6.5. We assume no responsibility for the content of websites linked to from the Website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
PART 2: TERMS OF SALE
- Ordering Products
7.1. You may order Products online directly from us on the Ordering Website for collection (“Takeaway Orders”) or for consumption in-restaurant (“Dine-in Orders”)
7.2. You must be at least 18 years old to place an Order.
7.4. In order to submit an Order via the Ordering Website, you must first register an Account and then follow the procedure set out on the Ordering to submit your Order. You should check all of the information that you enter and correct any errors before submitting your Order, as once your Order is submitted, we will begin processing it immediately and you may not be able to correct any errors (see clause 10 for further details).
7.5. Your Order constitutes an offer to us. We will confirm our acceptance of your Order by sending you an email confirming the information you included in your Order (the “Confirmation Email”). These Terms of Sale, the General Terms and the Order will become legally binding on you and us when we send you the Confirmation Email and each Order shall incorporate the Terms of Sale and General Terms and shall be a new and separate contract between you and us.
- Collection Time
8.1. Your Collection Time will be set out during the Order process when you submit a Takeaway Order.
8.2. If you do not collect your Takeaway Order within thirty (30) minutes of your Collection Time, your Products will be disposed of and you will not receive a refund.
- Payment
9.1. The prices for the Products are set out on the Ordering Website and are exclusive of GST.
9.2. It is always possible that, despite our best efforts, some of the Products may be incorrectly priced. We will normally check prices before accepting your Order so that, where a Product’s correct price at the time of your Order is less than our stated price at that time, we will charge the lower amount. If the Product’s correct price at the time of your Order is higher than the price stated to you, we will contact you for your instructions before we accept your Order. If we accept and process your Order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.
9.3. If your payment is not authorised, your Order will not be sent through to the restaurant or fulfilled.
9.4. Discounts or promotions are currently not available when ordering on the Ordering Website.
- Cancellation and refunds
10.1. You may request that your Order is cancelled or changed after it has been submitted, but this will only be possible before the applicable restaurant has started preparing the Order. This can be done by informing a restaurant manager. No refund will be permissible if the attempt to cancel is made after the restaurant has started to prepare the Order.
10.2. If you cancel or change your Order, your original payment may still be processed. Where you are eligible for a refund, you can obtain this by contacting our Customer Experience Team (see clause 27 below for the contact details). We will process refunds within ten (10) working days.
10.3. You have legal rights in relation to Products that are not as described, faulty or otherwise not fit for purpose. If you believe that any Products that you have ordered do not conform with these Terms of Sale, please speak to a restaurant manager or contact our Customer Experience Team to discuss a replacement or refund.
10.4. If, due to unforeseen circumstances, we are unable to fulfil your Order or any of the Products in a particular Order, we will refund the value of the Product(s) that we were unable to fulfil. You may obtain a refund by informing a restaurant manager or contacting our Customer Experience Team (see clause 18 below for the contact details).
- Products
11.1. We endeavour to provide information on any allergens that the Products may contain on the Nando’s Website, but please note that:
11.1.1. because all Products are cooked to order in the same kitchen we cannot guarantee and make no warranty that the Products will not contain any allergens;
11.1.2. the kitchen is a busy working environment and there is a risk of cross-contamination between ingredients;
11.1.3. For Takeaway Orders, customers with special dietary needs should contact the relevant restaurant (using the telephone number listed on the Nando’s Website) before they place their order to allow staff to take all reasonable precautions to avoid cross contamination; and
11.2. Our Products are freshly prepared and although we try our best to be consistent at times the size of the portions can vary.
- Liability
12.1. Nothing in these Terms of Sale excludes or limits our liability for:
12.1.1. death or personal injury caused by our negligence;
12.1.2. fraud or fraudulent misrepresentation; and
12.1.3. any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
12.2. If we fail to comply with these Terms of Sale, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Sale or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that the contract between you and us for your Order became binding (i.e. when the Confirmation Email for that Order was issued).
12.3. We are under a legal duty to provide you with Products that are in conformity with the terms applying to your Order. Nothing in these Terms of Sale affects your statutory rights.
12.4. We only supply Products for domestic and private use. You agree not to use the Products for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
12.5. Notwithstanding clause 12.2, and subject to clause 12.1, our maximum liability to you under these Terms of Sale in respect of any particular Order will be limited to the value of that Order (which includes any delivery charges) as set out in the relevant Confirmation Email.
PART 3: TERMS OF MEMBERSHIP
- Nando’s loyalty program (“Programme”) allows registered members (“Member”) to earn points based on spend at Nando’s (“Chillies“), these can converted into rewards (“Rewards”)
- No physical card will be given to Members; Members will be required to register an account (“Account”) via the Nando’s Mobile App, or via the Nando’s Ordering Website. To enjoy the Programme, if ordering through Ordering Website Member simply needs to log in. If not ordering through the Ordering Website, Member needs to show their “Membership Number” on Nando’s Mobile App every time Member makes a purchase at Nando’s.
- Membership
15.1 To be a Member, you may register for free via Nando’s Mobile App or Ordering Website.
15.2 To register, you are required to provide an active mobile number that is valid in Singapore, email address and other contact information as may be required by Nando’s from time to time. Each mobile number and email address can be registered for one membership only.
15.3 To activate your Account, you will be required to verify your Account within 30 days after the registration. To verify, you will be requested to enter a 4-digit verification, which will be delivered to you via SMS.
15.4 Chillies cannot be collected without a successful registration and activation of your membership. Once your account is registered and activated successfully, you will receive an email confirming your membership (“Membership”).
15.5 Your Membership is lifetime and will not expire unless there is a change of these Terms & Conditions.
15.6 Membership is only applicable at Nando’s Singapore and can only be used in Singapore.
15.7 Membership is not transferable.
15.8 Member should always update the registered contact details in the Account to ensure that Members do not lose their collected Chillies and Rewards as well as to enjoy the full benefits of the Programme. To update personal details, Member can log in to his/her Account by using his/her registered email and password on Nando’s Mobile App or Ordering Website.
15.9 To register as a Member, collect Chillies and claim Rewards, Member must be aged 18 and above and is a resident in Singapore. Minors must obtain their parent’s or legal guardian’s consent prior to participation. By submitting an application for the Membership, you agree (or, if you are a minor, your parent or legal guardian agrees) to be bound by these Terms of Membership.
15.10 All information provided by Member to us are based on reasonable assumption and all statements given are true and not misleading.
15.11 This Programme is open to all except the employees and the immediate family members of Nando’s, its promotion agencies, advertising agencies, PR agencies and any associate companies.
- Collecting Chillies and Rewards Redemptions
16.1 For every visit, with minimum spend amounting to $15 or more, excluding prevailing government tax and service charge, Member will be entitled to ONE (1) Chilli. Chilli will only be added into Member’s Account after the transaction is completed, i.e. when the payment has been made.
16.2 To collect a Chilli, if not ordering through the Ordering Website, Member must present Membership Number on the Nando’s Mobile App when ordering. Member will not be entitled to collect the Chilli if Membership Number is presented during or after payment.
16.3 In the event that Member is unable to present Membership Number on Nando’s Mobile App, Member will not be entitled for the Chilli. Presenting a screenshot of the Mobile App will be invalid.
16.4 Member may collect a Chilli only for dine-in and takeaway transactions. Collection of Chilli is also valid for transactions involving purchase of PERi-PERi Sauces in Nando’s restaurants.
16.5 Collection of Chilli is not applicable for Nando’s delivery, bulk purchases, catering service, purchase of Nando’s Gift Vouchers, Nando’s Staff Meals or any transactions involving other third parties such as Food Panda Deliveries. If Member is unsure whether an item qualifies, please seek help from Nando’s employees.
16.6 Member will be entitled to collect only ONE (1) Chilli per day. Member will not be entitled to Chilli for any subsequent purchase made on the same day.
16.7 Every third, sixth and ninth Chilli collected will automatically be converted into a reward and will be stored in Member’s Membership Account.
- 3rd Chilli collected will automatically be converted into 1 unit of Quarter Chicken a la carte
- 6th Chilli collected will automatically be converted into 1 unit of Half Chicken a la carte
- 9th Chilli collected will automatically be converted into 1 unit of Full Chicken a la carte
Nando’s reserves the right to change the rewards at any time.
16.8 These rewards CANNOT be redeemed as part of a Combo Meal.
16.9 A full cycle of Chillies collection is 9 Chillies. When Member have accumulated 9 Chillies, the collection will restart from 1 Chilli after the subsequent visit.
16.10 Each reward will be valid for 6 months from the date it was converted.
16.11 In the event Member finds that collection of Chilli and records of rewards are inaccurate, Member may contact our Customer Experience Team via email at peri-peri@nandos.com.sg.
16.12 To redeem a reward, Member must present Membership Number on the Nando’s Mobile App when ordering and verbally inform our staff that Member would like to redeem his/her reward(s). Member’s redemption will not be valid if Membership Number is presented during or after payment.
16.13 In the event that Member is unable to present Membership Number on Nando’s Mobile App, Member will not be allowed to make any redemption. Presenting a screenshot of the Mobile App will be invalid.
16.14 Member may redeem a reward only for dine-in and takeaway transactions.
16.15 Redemption of rewards is not applicable for Nando’s delivery, bulk purchases, catering service, Nando’s Staff Meals or any transactions involving other third parties such as Food Panda Deliveries.
16.16 The deduction of reward from Member’s Membership Account will be on first in, first out basis. The reward which is the soonest to expire will first be deducted.
16.17 Member can check his/her account balance in Membership Account on Nando’s Mobile App, or website. Member will be responsible for internet service charges, and we will not be liable for any failure of internet services. We reserve the right to correct or amend the balance in Member’s account if we believe that an invoicing or accounting error has occurred. If Member wishes to contest such correction or amendment to his/her account, please contact our Customer Experience team at peri-peri@nandos.com.sg.
16.18 The rewards collected in Membership Account cannot be exchanged for cash. Redemption of rewards can only be made by using Chillies collected from the same Membership Account. Member cannot transfer Chillies or rewards to any other person unless otherwise allowed by Nando’s based on its sole discretion.
16.19 It is not possible to merge the Chillies and/or rewards balances from more than one Membership account onto a single account.
16.20 Any rewards redeemed and deducted from Member’s account is not refundable.
16.21 The Programme allows a maximum of ten rewards to be spent per day from a single account.
- Limitations of Use of Membership
17.1 The membership may not be transferred, exchanged or used for any other purpose, except as specified in these Terms.
17.2 Nando’s shall not be liable for any damage in the event the Membership could not be used due to whatsoever reason including but not limited to failure of Nando’s IT and communications systems as Nando’s may not be able to add Chillies or allow Member to redeem reward(s) during such event.
17.3 Nando’s reserve the right to refuse any application for Membership or to impose limitation on the usage of the Membership if in the event Nando’s believe the elements of fraud, misconduct or unauthorized use is involved in the transaction. Nando’s may at any time suspend or cancel the Membership of the Member if Nando’s believe that the Membership has been used for or intended to be sued for fraud, misconduct or unauthorized use of the Membership. In the event of the aforesaid, the Membership will be invalid once suspended or cancelled by Nando’s and all the rewards in the Membership account will be forfeited.
- Nando’s Maximum Liability and exclusion of Warranties
18.1 Save for in the event of death or personal injury, Nando’s will only be liable for damages arising from negligence on the part of Nando’s or fraud and as permitted by law not more than the final balance rewards recorded in the Member’s account. Nando’s shall not be liable for any unforeseeable damages or damages beyond the reasonable control of Nando’s.
18.2 Nando’s will endeavour to provide the services relating to Member membership using reasonable skill and care.
18.3 Notwithstanding the above, nothing in these Terms shall affect statutory rights of the Member.
- Amendment of these Terms and Termination
19.1 Nando’s reserves the right to amend these Terms at any time or terminate this Programme by giving reasonable notice to Member. Any amendment on these terms will be posted on www.perivilege.com.sg/Terms.aspx.
19.2 If Member has successfully verified the registration, Nando’s will notify all the Members of any change, deletion or addition on the Terms by e-mail. The amended Terms will take effect immediately upon being posted on our website or such e-mail to the Member. In the event Nando’s decided to terminate this Programme, Nando’s will give a 30 days’ notice to the Member.
- Member Privacy
20.1 Nando’s Privacy Policy can be found at http://www.nandos.com.sg/privacy-policy/. Nando’s will use all the information provided by the Member according to the Privacy Policy. The Privacy Policy may be changed from time to time by Nando’s and the amended Privacy Policy will be posted at our website. Nando’s will not disclose Member’s information to any third party without the consent of the Member.
- Cancellation of Membership
21.1 In the event Member want to cancel his/her Membership, Member must contact our Customer Experience team via email at peri-peri@nandos.com.sg. All the remaining rewards in the Membership account will be forfeited upon termination of the Membership.
PART 4: GENERAL TERMS
- Suspension and termination
22.1. If you breach any of these Terms and Conditions, we may immediately do any or all of the following (without limitation):
22.1.1. issue a warning to you;
22.1.2. temporarily or permanently remove any User Generated Content uploaded by you to The Websites;
22.1.3. temporarily or permanently withdraw your right to use The Websites;
22.1.4. suspend or terminate your Account and Memberships (and any refunds for outstanding Orders and Rewards will be in our sole discretion);
22.1.5. issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);
22.1.6. take further legal action against you; and/or
22.1.7. disclose such information to law enforcement authorities as we reasonably feel is necessary to do so.
- Your personal information
23.1 We only use your personal information in accordance with our Privacy Policy (available at http://www.nandos.com.sg/privacy-policy/). Please take the time to read our Privacy Policy as it includes important information and terms which apply to you.
- Changes to these Terms and Conditions
24.1 We may make changes to these Terms and Conditions from time to time (if, for example, there is a change in the law that means we need to change these Terms and Conditions) but the Terms of Sale applicable at the time of your Order will apply to that Order. Please check these Terms and Conditions regularly to ensure that you understand the Terms and Conditions that apply at the time that you access and use the Websites.
- Other important information
25.1. Each of the clauses of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.
25.2. If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
- Governing law and jurisdiction
26.1. These Terms and Conditions are governed by Singapore law. This means that your access to and use of The Websites, your purchasing of Products, and any dispute or claim arising out of or in connection therewith will be governed by Singapore law.
26.2. You can bring proceedings in respect of these Terms and Conditions in the Singaporean courts.
26.3 As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms and Conditions affects your rights as a consumer to rely on such mandatory provisions of local law.
